EIB loans are provided for the purpose of contributing to the steady and balanced development of the Community by providing loans and loan guarantees for Capital investment projects in all sectors of the economy. The EIB borrows the major part of its resources on international capital markets- mainly through bond issues.

The ESF is one of the Structural Funds operated by the EC to improve workers' employment opportunities and raise their living standards. In general, the maximum benefit provided by the ESF is 50 percent of the project's total cost for the project. We determined that the funds provided under this program are specific and therefore countervailable.

CDC is a government institution that invests funds deposited in the Caisses d'Epargne (the French savings bank), pension funds, and insurance company deposits. CDC makes both short- and long-term loans to various industries.

The purpose of this program was twofold, first it was to provide early retirement for employees provided each were replaced by a newly hired employee and second to hire new employees for training. Any firm in France may use this program. Because it is generally available we determined that it did not constitute a subsidy.

LORDEX, CENTREST, and SUDEST are local economic development agencies which provide preferential funding to companies for the promotion of energy economies and exportation. Absent sufficient information to determined whether any of the loans they provided were solely for the purpose of energy conservation, we determined that these preferential loans are export subsidies within the meaning of the countervailing duty law.

These loans, issued by the FDES and the Caisse Francise de Development Industrial (CFDI), allowed the borrowers to pay a lower than market interest rate plus a share of future profit according to an agreed upon formula.

Credit National is a major financial institution which plays in important role in the French financial banking system, and it has a special legal status. Credit National issues loans to French industry, particularly the steel industry. Loan funds are raised by offering bonds in the public marketplace. Because Credit National loans and loan guarantees are industry-specific, we determined them to be subsidies within the meaning of the countervailing duty law.

The FDES, which was created by Parliament in 1955, lends funds to government-owned and privately held corporations for industrial development or relocation of facilities to further the government's regional development objectives. Because FDES provides loans on a regional basis, we determined these loans to be subsidies within the meaning of the countervailing duty law.

The Agence pour les Economies d'Energie (AEE) is a government agency, created in 1974, that provides grants to foster energy efficiency. Grants received from the agency may have to be repaid if target efficiency levels are not met. The government of France offers grants for the purchase of capital equipment. These grants are available to all industrial sectors in France for such projects as pollution control, energy conservation and waste disposal and are administered through various local government agencies.

Reduction of Benefit Costs

Under this program, companies may reduce by 50 percent for up to one year the amount of payments made to the government for health insurance, pensions and family allowances on behalf of those young people who are given new jobs. Created by Law No. 64-1245 of 1964, regional agencies provide incentives for the installation of anti-pollution devices. The agencies collect dues for the operation and in return award "bonuses" and loans to combat pollution.

Three government organizations provide research and development: 1) Agence Nationale de Valorisation de la Recherche (ANVAR) a public corporation which is designed to support innovation and enhance research; 2) Direction Generale de la Recherch Scientifique et Technique (DGRTS) a subdivision of the Ministry of Research and Technology; and 3) Agence de l'Informatique (ADI) a public corporation which promotes the use of computer technology. This research and development assistance is not awarded on a regional or industry-specific basis, and research results are made publicly available. Therefore, we determined that the amounts received under this program are not countervailable.

Seine-Normandy Water Agency Assistance

The Seine-Normandy Water Agency ("SNWA") is a public institution with financial autonomy and is administered jointly by the Ministries of the Environment and Finance. SNWA provides financial assistance in the form of grants and loans to companies located along the Seine for projects dedicated to protecting, increasing, and improving the water resources, attaining quality requirements, and protecting against flooding. Pursuant to Article 14 and Article 14-1 of the Water Law of 1964, all polluting companies having plants located in the basin of the Seine River, regardless of their sector of activity, have the legal obligation to enter into the SNWA consortium and fund its activities through the payment of levies. We determined this program was not countervailable.

Investment tax deductions and investment tax credits are available under the following three French laws: (1) No. 75-408 (May 29,1975) which provided a 10% tax deduction on industrial investments; (2) No. 79-525 (July 3, 1979) which provided tax credits equal to 10% of the increase in expenditures for investment; and (3) No. 81-1160 (December 30, 1981) which provided tax credits equal to 10% of the cost of investments. Because these tax credits and deductions are available to all industrial sectors and not specific to any particular regions in France, we determined that they are not countervailable.

Employers who hire young people (aged 16-25) through various government-administered work/training and apprenticeship contracts may receive grants and an exemption from social security contributions.
