COUNTERVAILABLE SUBSIDY PROGRAMS

The subsidy programs listed below have been investigated by the Department and have been found to be "countervailable" based on the criteria established in the Tariff and Trade Act of 1930, as amended. SUBSIDY PROGRAMS FOUND TO BE NOT COUNTERVAILABLE

The subsidy programs listed below have been investigated by the Department and have been found to be "not countervailable" based on the criteria established in the Tariff and Trade Act of 1930, as amended. Research and Development Support

Certain Flowers (1985) 51 FR 37942 (10/27/86-prelim);   52 FR 9522 (3/25/87-final)

The Government of Kenya funded a portion of costs of research projects undertaken at the National Potato Research Station and at the Horticultural Research and Development Project. The results of this research are made available for all types of flowers, whether exported or not, and are available to producers in any part of the country. The results of this research are also made publicly available through publications of annual reports or on request from farmers, with farmers bearing their own costs when using results from this research. Because the results are made publically available on equal terms, and because research is conducted on a wider variety of horticultural and agricultural products, we determined that this program was not countervailable.

SUBSIDY PROGRAMS THAT HAVE NOT BEEN USED

When potential subsidy programs are investigated and found not to be used by the companies being investigated, the Department makes no determination as to their countervailability. Export Compensation Act

Certain Flowers (1985) 51 FR 37942 (10/27/86-prelim);   52 FR 9522 (3/25/87-final) not used

The Local Manufacturers' Export Compensation Act was established in June 1982. Under this program, the Government of Kenya offers export incentives in the form of a 20 percent payment to the exporter of the value of the export. These payments are available only to exporters of manufactured products. This Act does not provide for duty drawback nor for a refund of sales tax.

Investment Allowances

The Income Tax Act allows for a grant of 50% against taxable income for new construction of buildings and for new machinery placed in those buildings, if located outside the two major metropolitan areas. This allowance is available only to the manufacturing sector.
