FINAL RESULTS OF REDETERMINATION PURSUANT TO COURT REMAND

SUMMARY

The Department of Commerce (the Department) has prepared these final results of redetermination pursuant to the remand order from the U.S. Court of International Trade (CIT) in the case of RHP Bearings Ltd. v. United States, Court No. 97-02-00217, Slip Op. 99-134 (CIT December 16, 1999) ("NSK").

On January 21, 2000, the Department released draft results of redetermination pursuant to the remand order in Slip. Op. 99-134 to all parties for comments. We received no comments.

BACKGROUND

On December 16, 1999, the CIT issued an order in NSK, remanding to the Department the final results of the 1994-1995 administrative review of the antidumping duty order on antifriction bearings (other than tapered roller bearings) and parts thereof from the United Kingdom (Final Results).(1) The period of review (POR) covered is May 1, 1994, through April 30, 1995.

In NSK, the CIT remanded the Final Results to the Department to exclude from NSK/RHP's U.S. sales database any sample transactions that were not supported by consideration and to include imputed inventory carrying costs in the calculation of the constructed export price (CEP) offset for NSK/RHP when matching CEP sales to constructed value.

DISCUSSION

In accordance with the CIT's instruction, we have recalculated margins for NSK/RHP by excluding from NSK/RHP's U.S. database any sample transactions that were not supported by consideration and including imputed inventory carrying costs in our CEP-offset calculation.

FINAL RESULTS OF REDETERMINATION

As a result of this redetermination, we have recalculated the weighted-average percentage dumping margins for NSK/RHP for ball bearings and cylindrical roller bearings as follows:
