FAG Italia S.p.A., The Barden Corporation (U.K.) Ltd., The Barden Corporation and FAG Bearings Corporation v. United States

Slip Op. 00-95 (CIT August 4, 2000)

FINAL RESULTS OF REDETERMINATION PURSUANT TO COURT REMAND

SUMMARY

The Department of Commerce has prepared these final results of redetermination pursuant to the remand order of the U.S. Court of International Trade in FAG Italia S.p.A., The Barden Corporation (U.K.) Ltd., The Barden Corporation and FAG Bearings Corporation v. United States, Slip Op. 00-95 (CIT August 4, 2000). In accordance with the U.S. Court of International Trade's instructions, we have disregarded The Torrington Company's below-cost allegation and recalculated the dumping margin with respect to the Barden Corporation (U.K.) Ltd., the Barden Corporation, and FAG Bearings Corporation (collectively "Barden") without regard to the results of the below-cost test for the May 1, 1996, through April 30, 1997, review period.

On October 18, 2000, the Department released to interested parties for comment the draft results of redetermination pursuant to court remand. We did not receive any comments.

FINAL RESULTS OF REDETERMINATION

As a result of not performing the below-cost test for Barden, Barden's weighted-average margin for the period of review changed from 6.63 percent to 5.06 percent for ball bearings.

Upon a final and conclusive court decision affirming our remand determination, we will publish an amended final results of review to that effect.
